General Terms and Conditions of Sale (GTCS)

Article 1: Identification of the Seller

The present General Terms and Conditions of Sale (hereinafter "GTCS") govern the contractual relationship between any user of the website (hereinafter "Customer") and the merchant (hereinafter "Seller").

Article 2: Application and Enforceability

These GTCS apply to all sales of products concluded via the website https://www.elch.be. By placing an order, the Customer unreservedly accepts these terms. These terms prevail over any other document or previous correspondence.

Article 3: Products and Pricing

3.1. Description: The products offered for sale are those described on the website on the day the Customer consults the site. The Seller takes the greatest care in the presentation and description of these products. However, slight physical variations (e.g., color shades) may occur.

3.2. Pricing: Prices are indicated in Euros (€) and include the Value Added Tax (VAT) applicable in Belgium.

3.3. Environmental Contributions: For electronic and electrical appliances, the displayed price includes the mandatory Recupel (e-waste) and Bebat (batteries) contributions required by Belgian law.

3.4. Pricing Errors: In the event of a manifest error in the price display (e.g., a €1,000 TV listed for €10 due to a technical glitch), the Seller reserves the right to cancel the order and refund the Customer, even if an automated confirmation was sent.

Article 4: Ordering Process and Contract Formation

4.1. Contract Conclusion: The sales contract is legally formed only when the Seller sends the Shipping Confirmation or Ready for Pick-up email to the Customer. The automated "Order Acknowledgement" email received immediately after payment confirms receipt of the request but does not constitute legal acceptance of the sale.

4.2. Availability: Offers are valid as long as they are visible on the website. In the event of stock unavailability from the supplier after an order is placed, the Seller will inform the Customer and process a full refund immediately.

Article 5: Payment

Payment is due immediately upon ordering. The Customer guarantees that they are authorized to use the chosen payment method (Visa, Mastercard, PayPal, bank transfer, etc.). Transactions are secured by an encrypted SSL protocol via a third-party payment processor. The Seller does not store banking data.

Article 6: Delivery, Local Pick-up, and Transfer of Risk

6.1. Shipping & Pick-up Costs: Delivery is free of charge to all countries in the European Union. We also offer a free Local Pick-up option at our physical premises. For full details on shipping methods, times, and restrictions, please consult our Shipping Policy.

6.2. Delivery Modes: In accordance with Article VI.45/2 of the Code of Economic Law, the Seller offers the following delivery modalities:

  • Standard Home Delivery.
  • Delivery to a Pick-up Point (subject to parcel size and carrier availability).
  • Local Pick-up directly at our store/warehouse.

Note: For bulky items (e.g., large TVs, washing machines) where Pick-up Point delivery is technically impossible, only Home Delivery or Local Pick-up will be offered.

6.3. Transfer of Risk: The risk of loss or damage to the goods passes to the Customer only when the Customer (or a third party designated by them other than the carrier) takes physical possession of the goods. For Local Pick-up orders, this risk transfers the moment the Customer physically collects the goods from our premises.

6.4. Inspection: Upon delivery or pick-up, the Customer must inspect the packaging. If the package appears visibly damaged, the Customer must refuse it or clearly note "Damaged Package" on the delivery slip and contact the Seller within 24 hours.

Article 7: Statutory Right of Withdrawal (14 Days)

7.1. Principle: In accordance with the Code of Economic Law, the Customer has the right to withdraw from the contract without giving any reason within 14 calendar days from the day following the delivery or collection of the goods. To exercise this right, the Customer may use the model withdrawal form provided in Annex 1, or submit any clear, unambiguous statement indicating their decision to withdraw.

7.2. Conditions of Return: The Customer may unpack and inspect the product to establish its nature, characteristics, and functioning (as one would in a physical store). However, the Customer is liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature and functioning of the goods (e.g., physical damage, scratches, missing accessories).

7.3. Cost and Procedure: Return shipping is free of charge. The Customer must contact customer service to obtain a pre-paid return label. For detailed steps, please consult our Returns Policy.

Article 8: Commercial Return Policy (Days 15-30)

8.1. Extension: As a commercial gesture, the Seller extends the return window from day 15 to day 30 following delivery or collection.

8.2. Conditions & Cost: The conditions of return (Article 7.2) remain identical during this extended period. Return shipping remains free of charge. The Customer must contact customer service to obtain a pre-paid return label.

Article 9: Legal Guarantee of Conformity

9.1. Duration: All electronic goods sold to consumers are covered by the mandatory 2-year legal guarantee of conformity under Belgian law (Articles 1649bis to 1649octies of the Civil Code).

9.2. Coverage: This guarantee covers lack of conformity existing at the time of delivery that manifests within two years. It covers the repair or replacement of the defective good free of charge.

9.3. Exclusions: The guarantee does not apply to damage caused by external accidents, negligence, misuse by the Customer, or normal wear and tear.

Article 10: Liability

The Seller is not liable for the non-performance of the contract in case of force majeure (e.g., natural disasters, general transport strikes) or due to the unpredictable and insurmountable act of a third party.

Article 11: Privacy Policy

Personal data is processed in accordance with the General Data Protection Regulation (GDPR). Data is shared with logistics partners solely for the purpose of fulfilling the delivery. For full details, please consult our Privacy Policy.

Article 12: Applicable Law and Disputes

12.1. These terms are governed by Belgian Law.

12.2. Mediation: In the event of a dispute, we will attempt to find an amicable solution. If no agreement is reached, the Customer may contact the Consumer Mediation Service (Service de Médiation pour le Consommateur):

12.3. Jurisdiction: Any judicial dispute shall be brought before the competent courts of the district of Ranst.
